1. Acceptance of Terms & Eligibility

By creating an account or accessing ineship, you affirm that you are at least 18 years old and legally competent to enter into a binding agreement. Use of the platform for dating, companion discovery, or service bookings is contingent upon completing biometric KYC verification.

2. Code of Conduct & Community Standards

Ineship enforces strict mutual respect. The following activities result in immediate, irreversible account revocation and potential criminal reporting:

• Submitting fraudulent identification or misrepresenting identity, age, or gender.
• Harassment, non-consensual sexual solicitation, stalking, or discriminatory behavior.
• Attempting to bypass the OgottoPay escrow rail by soliciting off-platform cash loans or wiring requests.

3. Travel Companionship & Assumption of Risk

While ineship verifies user identities through in-app biometric KYC and authenticates accounts via utambuliSSO, each user remains responsible for their personal safety during in-person travel and meetups. Users must follow ineship's Community Safety Guidelines, meet initially in public venues, and verify travel plans prior to committing shared expenses.

Companion Fees vs. Trip Incidentals: Fees declared on companion profiles represent compensation for personal time, guidance, and companionship. The traveler booking the companion is exclusively responsible for paying all trip incidentals incurred during meetups, including meals, drinks, ground transport, fuel, and activity/park admissions. For multi-day or overnight itineraries, the booking traveler must provide or fund separate, private room accommodations for the companion; shared accommodations are strictly forbidden.

4. Escrow & Service Provider Marketplace

All payments for shared travel splits or certified local guides are held in licensed OgottoPay escrow vaults. Funds are released exclusively upon dual confirmation or verified milestone delivery. Dispute arbitrations are mediated pursuant to our Escrow Resolution Policy.

5. Independent Platform Status & Intermediary Safe Harbor

Ineship is an online technology marketplace and intermediary platform. Ineship is not a dating agency, travel agency, tour operator, transportation carrier, lodging provider, private security service, or employer. Hosts, travel companions, and daters are independent third parties and are not employees, partners, agents, or contractors of Ineship. Ineship does not direct, manage, or supervise offline meetups, itineraries, or private communications between members.

6. Disclaimer of Warranties ("AS IS")

To the maximum extent permitted by applicable law, the Ineship platform, services, and content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory.

While Ineship employs biometric KYC verification via utambuliSSO to deter fraudulent accounts, Ineship makes no warranty or representation that: (a) any user identity is permanently free from deceit; (b) in-person interactions will meet your expectations or be safe; or (c) any host service or travel companion will fulfill their obligations without breach. You assume complete, unilateral responsibility for exercising personal judgment and discretion during all offline interactions.

7. Limitation of Liability

To the fullest extent permitted by the laws of the Republic of Kenya and applicable international law, in no event shall Ineship, Ogotto Holdings Limited, its founders, directors, employees, or affiliates be liable for any:

• Indirect, incidental, special, consequential, or punitive damages;
• Bodily injury, personal injury, emotional distress, illness, death, assault, or property damage arising out of or related to offline meetups, travel companionship, transportation, dating, or host stays;
• Loss of profits, data, goodwill, or personal property;
• Any defamatory, offensive, or illegal conduct of any third party or platform member.

In all events, Ineship's total aggregate liability arising out of or relating to your use of the platform shall not exceed the greater of the fees paid by you to Ineship in the six (6) months preceding the incident, or KES 10,000 (ten thousand Kenyan Shillings).

8. Indemnification

You agree to defend, indemnify, and hold harmless Ineship, Ogotto Holdings Limited, and their respective officers, directors, and agents from and against any claims, liabilities, damages, losses, and legal expenses arising out of or in any way connected with: (a) your breach of these Terms; (b) your offline conduct, interactions, or agreements with other users; or (c) any injury or damage caused to any third party during an Ineship meetup or journey.
